Mandatory Drug Sentences and Sentencing Ranges for Drug Conviction:

Under 21 U.S.C. 8841 or 846 and 21 U.S.C. 960 or 963

Marijuana:

• 1000 Kilograms or 1000 plants: Ten years Minimum mandatory. Sentencing range is 10 years to life
• 100 Kilograms or Plants - 999 Kilograms or Plants- Five years Minimum. Sentencing Range is five years to forty years.
• 50 Kilograms or plants - 99 Kilograms or Plants- No minimum mandatory. Sentencing range is zero years to twenty years.
• Less then 50 kilograms or Plants- no minimum Mandatory. Sentencing range is zero to five years.

Cocaine Base or Myth:

• 50 grams or More: Ten year Minimum Mandatory. Sentencing Range is 10 years to Life.
• 5 grams to 49.9 grams: Five year Minimum mandatory. Sentencing range is Five years to forty years.
• Under 5 grams: No minimum mandatory. Sentencing guidelines is up tp 20 years.

Cocaine:

• 5 Kilograms or more: 10 year Minimum Mandatory and up to life.
• 500 grams to 499.9 kilograms: 5 year Minimum Mandatory and up to 40 years
• under 500 grams: no Minimum Mandatory. Sentencing Guidelines is up to 20 years.
